GLIDE HOUSE FOOD ORDERING MOBILE APPLICATION (APP) TERMS Please read these terms before you place a food order as these terms will apply to any orders you place. 1. How to contact us If you have any queries about these terms please contact us by using the phone or e-mail displayed in the App. 2. Acceptance of these terms By placing an order with us you confirm that you accept these terms and that you agree to comply with them. If you do not agree to these terms, you must not use our App and should not place an order with us. 3. Who we are GLIDE House and the GLIDE House food ordering App is operated by Gripple Limited (referred to as “we”, “our” or “us” in these terms). Our company registration number is 017772901 and our registered office is The Old West Gun Works 201 Savile Street East, Sheffield, South Yorkshire, England, S4 7UQ. Our registered VAT number is GB 600 1951 88. 4. Revision of these terms We may revise these terms from time to time. Any changes will be published on our App and you will be subject to the terms in force at the time that you place your Order. 5. The order process You may only submit an Order following the method set out in the App. 6. Your obligations and errors in your order By placing your Order you are confirming that you are legally capable of entering into a binding contract with us. Please check and amend any errors before submitting and confirming your Order. You are responsible for ensuring that your Order is complete and accurate as once you submit your Order errors cannot be corrected. 7. Confirmation of receiving your Order On receipt of your Order, we will notify you by email and a notification in the App that your Order has been received, but please note this does not mean that your Order has been accepted by us. 8. Acceptance of your Order Acceptance of your Order will take place once you receive an order confirmation email. We reserve the right to refuse your Order if it is below £10. We can also reject orders at any time if we are unable to meet capacity, due to weather conditions or for any other reason. If your Order is rejected we will refund any payment made in respect of your Order. 9. Changing or cancelling your Order You cannot change or cancel your Order once it has been submitted. It is at our sole discretion whether to accept any change or cancellation of your Order. 10. Food allergies If you have a food allergy or intolerance you must notify us prior to placing your Order. Please telephone us on the number displayed in the App. Some of our ingredients may contain allergens or may be produced in factories which handle allergens. We therefore cannot guarantee against cross contamination with products containing allergens even if ingredients have been removed on your request. If you have an allergy or food intolerance please telephone or e-mail us using the details displayed in the App. If we are unable to fulfil an Order already made because of the allergy or food intolerance information you provide to us we will offer you a full refund. 11. Delivery of your Order We will only deliver to the sites listed in the App. We will always try to deliver on time. However we cannot guarantee that your Order will be delivered within the estimated times and you will not be able to cancel your Order or claim compensation for delayed delivery. 12. Pricing errors In the unlikely event that the price displayed in the App is incorrect we will contact you before your Order is dispatched to notify you of the correct price and you will have the option to cancel the Order. If this occurs we are not under any obligation to provide the Order to you at the incorrect price or to compensate you in respect of the incorrect pricing. 13. Payment Payment for Orders must be made by a credit or debit card through the App when you place your Order. 14. If payment fails to clear If your payment for an Order does not successfully process for any reason you must ensure that full payment for the Order you have received is immediately made (“Successful Payment”). If a Successful Payment is not promptly received by us you will remain liable to us for your failure to make a Successful Payment. 15. Complaints We hope you will be satisfied with your Order. However in the unlikely event that you need to raise an issue with us please contact us on the number or e-mail provided in the App. 16. Our liability We only supply food for private consumption and you agree not to re-sell your Order. If we fail to comply with these terms we are responsible for any foreseeable loss or damage you suffer as a result of our breach of contract or negligence up to the amount of the price you paid for your Order relating to your claim. We do not exclude liability for: Death or personal injury caused by our negligence Fraud or fraudulent misrepresentation. 17. Any other liability which cannot be excluded We will not be liable for any failure or delay of our obligations that is caused by an event outside our control. In this circumstance our obligations will be suspended until we can perform our obligations or at our discretion we may cancel your Order and arrange a refund. 18. How we may contact you We may contact you by telephone, e-mail or a postal address you give in the App. If we are legally required to contact you in writing you agree that we can contact you by e-mail or by posting information in the App. 19. Processing your personal data Further details of how we will process personal information are set out in our privacy policy which is available on the App. 20. App availability and access Although we try to ensure the App is available at any time we are under no obligation to do so and the App may be unavailable at any time and for any period of time. Access to the App may be terminated or suspended at any time without notice. 21. Third party rights No party other than a party to these terms shall have the right to enforce any of its terms. 22. Law and jurisdiction Any disputes or claims arising out of your Order (including non-contractual disputes) will be governed by English law and the English courts shall have exclusive jurisdiction over any disputes which may arise in connection with your Order (including non-contractual disputes).
